While we work to incorporate the celebration into everything we do for the year, it will also coincide with BAMSL Past President Bill Bay’s term as president of the ABA. In U.S. patent practice, it is not uncommon for applicants to pursue protection for their invention in a series of related continuing applications containing the same or similar disclosure. Often, an applicant secures protection for a more narrowly defined embodiment of the invention in a first application, and then seeks claims of a broader or slightly different scope in one or more later‑filed applications claiming priority to the earlier filed application. The claiming strategy employed in the later-filed applications is sometimes informed by the commercial activities of a competitor attempting to design around the claims issued in the earlier application. So long as the subject matter claimed in the later filed application(s) is adequately described and enabled by the original disclosure, a family of U.S. patents may ultimately be issued, each entitled to the priority of the earliest filed application. The Federal Circuit's recent decision in In re Cellect, LLC1 reminds unwary patent owners and their counsel of the risks in obtaining multiple related U.S. patents containing claims to similar inventions overlapping in scope.
