Last March, the Internal Revenue Service dropped a long-anticipated revenue ruling ostensibly negating a questionable argument that had been promoted for quite a few years by some tax planning lawyers.

Unfortunately, the ruling is expressly limited by conditions that largely swallow the rule. And it leaves intact another revenue ruling, from the mid-1980s, which is the actual source of the problem.

The murder of Nancy Zanone, a young mother in south St. Louis, was front-page news in St. Louis in 1963 and would return there throughout the decade as the prosecution of her killer made its way through Missouri’s courts. Ultimately, the accused, a 15-year-old boy named Joseph Arbeiter, was not convicted for his conduct.

In practice, lawyers’ use of GenAI varies widely. Some are not using it at all or are only beginning to experiment with tools like ChatGPT and Microsoft Co-Pilot for tasks such as client correspondence and marketing. Progressive firms, however, are developing formal processes to leverage GenAI for competitive advantage. Others are staying informed but are not yet ready to invest in it.
