The Probate & Trust Law Section of the Bar Association of Metropolitan St. Louis is proud to present "ABCs of Estate Planning,” a series of three two-hour morning CLE seminars intended for new graduates, non-estate planning attorneys interested in expanding their practice area capabilities or those who may be seeking additional training during a period of unemployment.

Session I
Wednesday, January 8, 2014

Overview of the Probate Process, Estate and Trust Administration and Non-Probate Transfers
The first hour of this session will cover the probate process, including filings required to administer an estate (Application for Probate of Will and Letters Testamentary, Small Affidavits, Inventories, Accountings and Settlements). The second hour will cover the basics of trust administration, including the duties and responsibilities of a trustee. An introduction to non-probate transfers will also be discussed.

8:00 a.m. – 9:00 a.m. Drafting Principles for Wills, Trusts and Durable Powers of Attorney
By attending this session you will gain exposure to the basic documents used in putting together an estate plan for a client. This session will cover the client interview process, powers of attorney, basic wills, and revocable trusts. It will highlight the data gathering process as well as things to consider when drafting documents to meet a client’s needs. (Speaker: Adam Goldstein)

9:00 a.m. – 10:00 a.m. Essential Estate Planning
This session will cover client interviews, powers of attorney, basic wills and revocable trusts. The session includes discussions on conducting a client interview and gathering personal and financial data, use of powers of attorney, living wills and medical directives and basic dispositive provisions included in wills and trusts. Fiduciary selection will also be discussed. (Speaker: Adam Randle)

8:00 a.m. – 9:00 a.m. Fiduciary Responsibilities and an Overview of the MUTC
This session will focus on defining a fiduciary and explaining the various duties imposed on fiduciaries. The discussion will include considerations in fiduciary selection and highlight the difference between the use of individual and corporate fiduciaries. Lastly, we will cover major features of the Missouri Uniform Trust Code (MUTC) and how it has changed estate planning and administration in Missouri since its adoption in 2005. 9:00 a.m. – 10:00 a.m. Elder Law for the Estate Planner
While you might know how to avoid probate and skip a generation or two, do you really understand the complexities of long-term care planning enough to advise your client? This session will cover an overview of how to incorporate the issues of long-term care planning and other hot topics in elder law into your practice. (Speaker: Christine Alsop)


Renea Harbert, U.S. Trust
(Overview of the Probate Process, Estate and Trust Administration and Non-Probate Transfers)
Renea Harbert manages the Estate Settlement Group at U.S. Trust, Bank of America Private Wealth Management and is responsible for the administration of decedent’s estates and trusts and for post-mortem estate and tax planning. Harbert received her J.D. from Valparaiso University School of Law in 1996 and her LL.M. degree in taxation from Washington University of St. Louis School of Law in 2002. She is a member of the Missouri Bar, Bar Association of Metropolitan St. Louis and the Estate Planning Council of St. Louis

Adam Goldstein, Buckingham
(Drafting Principles for Wills, Trusts and Durable Powers of Attorney)
Adam Goldstein is a portfolio advisor for Buckingham, an independent member of the BAM ALLIANCE. He joined the firm in 2013. Prior to joining Buckingham, Adam worked as an advisor for Parkside Financial Bank & Trust. His civic contributions include serving on the Angels’ Arms board and being a member of the steering committee for the Bar Association of Metropolitan St. Louis’ Probate & Trust Committee. Adam holds a bachelor’s degree from the University of Missouri – Columbia. He earned his Juris Doctor from Saint Louis University and his Masters of Law from Washington University School of Law.

Adam Randle, Polsinelli PC
(Essential Estate Planning)
Mr. Randle advises clients with respect to all areas of their estate planning, including the preparation of wills, revocable trusts, irrevocable insurance trusts, durable powers of attorney and health care directives. Mr. Randle also has experience implementing more sophisticated estate and gift tax planning techniques such as family limited partnerships, grantor retained annuity trusts, qualified personal residence sales to intentionally defective grantor trusts, charitable remainder trusts and private foundations. He also handles trust reformations, post-death trust and estate administration matters, guardianships and conservatorships and preparation of gift tax, estate tax and fiduciary income tax returns. He received his J.D. from Saint Louis University in 2003 and B.S. from Eastern Illinois University in 2000.

Deborah Smiley, PNC Wealth Management
(Fiduciary Responsibilities and an Overview of the MUTC)
Deborah Smiley has over 19 years of legal and financial experience with an emphasis on estate, business and financial planning. She assists high net worth clients with wealth, business and investment strategies in her role as a Senior Wealth Planner with PNC. Deborah received her J.D. from University of Kentucky College of Law and a Bachelor of Arts, Cum Laude, from the University of Kentucky. She is also a Certified Financial Planner, CFP®. Deborah is a member of the Missouri Bar Association, Vice Chair of the BAMSL Probate & Trust Section and sits on the board of the St. Louis Estate Planning Council.

Christine Alsop, The Elder and Disability Law Firm of Christine A. Alsop, LLC
(Elder Law for the Estate Planner)
Christine A. Alsop, owner of The Elder and Disability Law Firm of Christine A. Alsop, LLC, has extensive elder law experience as well as significant litigation and advocacy experience. She regularly represents fiduciaries and family members in contested probate, trust and guardianship matters as well as fiduciary litigation. She is also experienced in helping families with long term care issues, including Medicaid, Veteran’s Benefits, estate planning, asset protection and Special Needs Trusts. She is a member of both the Missouri and Illinois Bars and is also admitted to practice before the United States Supreme Court. She is a member of the National Academy of Elder Law Attorneys and served as Chair of the Advocacy and Litigation Section of that organization. She graduated from Valparaiso University School of Law, where she was honored for her outstanding work in trial advocacy.
